SECURITY
First Step Phonics and Crush Publishing, Inc. (or “FSP,” “CPI,”  “Company,” “us,” “we” or “our”) believe that strong electronic privacy is crucial for the ongoing success of our products. This site has security measures in place to protect the loss, misuse and alteration of the information under our control. CPI/FSP will take every precaution to preserve and keep confidential your personal information. However, information relayed over the internet or stored on servers cannot be guaranteed. Crush Publishing, Inc. and First Step Phonics cannot assume any responsibility for loss, damage, or harm users may experience or incur from inputting confidential information over the internet.

PASSWORDS AND USER IDS
New customers create their own user IDs and passwords at the time of registration. Customers are strongly encouraged not to make this access information available to other individuals.

SHOPPING CART
Our site uses an order form and shopping cart for customers to purchase products. We collect visitors' contact information (email address), unique identifiers (specifically their user ID and password), and financial information (like their account or credit card numbers).
Financial information that is collected is used to charge the customer for any products ordered from FSP. Unique identifiers (such as user IDs and passwords) are collected from website visitors to verify the user's identity when placing an order. Contact information from the order form is used to update the member's account and product purchase. The member's contact information is also used to get in touch with the customer when necessary.

ELECTRONIC COMMUNICATIONS
When you visit CPI or FSP or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

CHOICE/OPT OUT
CPI and FSP periodically send our customers electronic information we believe to be of value, including news, releases, or discount offers. If a customer wishes to opt out of receiving such information, instructions will be provided on every newsletter for simple removal from our list.

HOW WE COLLECT INFORMATION
We do not collect personally identifiable information, such as your name and address, simply by your viewing our website. Any data we collect in this manner will be details such as how long you visited our website, the type of device used to access, etc. The only way we will collect identifiable personal information on you is if you create an account, order a product, or subscribe to our newsletter. Any participation on your part remains voluntary. If you choose not to provide information, such as name, shipping address, and payment information, you will not be able to purchase our products.


NONPERSONAL INFORMATION
Nonpersonal information does not identify who you are, so we do not limit the ways we may use or share this information.

HOW WE USE OR SHARE INFORMATION
FSP and CPI do not give out, sell, broker, or otherwise distribute mailing lists, contact information, or personal demographics information to third-party companies or noncustomers. CPI/FSP will never share your account information. Information we collect is the personal information you provide, such as mailing address, email address, or payment info in connection to an account created by you and/or an order you placed.  Your information will not be shared. Not with anyone. Ever. We respect your privacy and will only use your information in connection with your orders. If you opted in to our newsletters, you will receive alerts, news, tips, special offers, discounts, new releases, and more.
However, if you email us a testimonial, we may share it in marketing materials or post it on our website or social media. Same policy applies to any pictures you send to us. If you send us a picture of your child, you are giving us permission to share or post it publicly. However, we will never include your or your child’s full last name.
In the case that we are required by law, or in the event that CPI/FSP is sold, we may disclose your personal information. In case of intellectual property infringement or fraud, we may disclose your personal information in an effort to protect CPI/FSP.
This privacy policy does not apply to information collected off-line or any third-party website, including our affiliates or vendors.

COOKIES
Websites use what are called "cookies" to store member names and passwords. Cookies allow us to both store and retrieve log-in information through a user's browser, which enables our site to recognize you when you visit our site.

CPI and FSP use cookies to transfer user ID information from one page to the next within our site, and for validation of user ID in protecting your account from being accessed by an unknown party.
Our site's registration form requires users to give us contact information (name and email address). We use customer contact information from the registration form to send the user information about our company as well as information on new releases, specials, etc. The member's contact information is also used to contact the visitor when necessary.
These “cookies” do not allow FSP or CPI to alter or access your computer in any way.

RETURNS
This policy stands unless otherwise agreed in writing between CPI/FSP and customer.
Before any product is returned, you must email orders@firststepphonics.com to obtain a return code. This code must be on the outside of the box as well as inside the box. The inside number must be on an 8.5 x 11 sheet of paper and must be legible. Orders that do not have the code clearly marked on the outside of the box may not be accepted.
First Step Phonics provides free shipping on most orders and therefore will not take responsibility for costs of return shipping on orders that received free shipping. However, once product is returned and arrives at the above address, refund for the cost of the product will be initiated, providing the product is in expected condition. Please allow several days to see the credit to your account.
All returns must be received at PO Box 6088, Gardnerville, NV 89460 within 30 days of purchase. If product arrives to purchaser damaged, Crush Publishing, Inc. must be notified within 10 days of receipt of product by emailing orders@firststepphonics.com. If purchaser desires to return product for any other reason, only undamaged and unused product will be accepted. 

SHIPPING AND HANDLING
At this time, CPI/FSP uses the United States Postal Service exclusively for shipment of all products.

All retail orders are shipped out from our warehouse within 1 to 2 business days.

MENTAL HEALTH INFORMATION AND DISCLAIMER
CPI and FSP make no claims or diagnoses as to mental health or such disorders as dyslexia or any other learning disabilities. CPI/FSP make no claims as to Company’s ability to cure or resolve any of the above or similar disabilities.

DISPUTES
Liquidated Damage Provision: For good and justifiable consideration, the parties to this contract do hereby agree to a liquidated damage provision of the cost of the product purchased. The cost of the product is set based on this provision.
Mandatory Mediation Agreement: The contracting parties agree to select a mediator and complete mediation before any litigation is demanded or filed. The moving party must send a demand for mediation in writing, return receipt request, and responding party has 30 days to respond. If the moving party doesn’t comply with the above, the moving party forfeits all rights to attorney fees, expert fees, and all costs.
If the moving party complies and responding party does not comply with these terms, the responding party forfeits all attorney fees, expert fees and costs. If both parties comply, a mediator with knowledge of the consumer industry will be selected by the parties. If parties can’t agree, a motion can be filed and a court will appoint a mediator. Both parties share the costs of a mediator as a recoverable cost.
Attorney Fees: If any action in law or equity is filed by any party to this agreement, the prevailing party shall be entitled to attorney fees, costs and all expenses including experts, conditioned on compliance with the mediation and arbitration clauses.
Mandatory Binding Arbitration Clause: Assuming that all terms and conditions of the Mediation Clause have been complied with, waived, or lost, the parties to this contract are required to complete the binding arbitration. If one party refuses, that party waives all rights to attorney fees, costs and expert fees. Should the parties not agree on an arbitrator, either party can file a motion with the court and have the court appoint the mediator. The same requirements of a mediator apply to the arbitrator even if appointed by the court. The decision of the mediator is final.
The parties have the right to the same discovery as if the parties were in court. The parties agree to voluntarily waive all rights to a trial by jury or judge as well as any actions for punitive damages. All notices of binding arbitration must be served in the same manner set forth in the “Mandatory Mediation Clause.” Any party failing to comply waives all rights to attorney fees, costs and expert fees. Decision of the arbitrator is final and without right of appeal. The arbitrator is to hear all post-arbitration motions (attorney fees, costs, etc.).
Any dispute relating in any way to your visit to CrushPublishing.com or FirstStepPhonics.com or to products offered by or through CrushPublishing.com or FirstStepPhonics.com in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $5,000 shall be adjudicated in any state or federal court in Douglas County, Nevada, and you consent to exclusive jurisdiction and venue in such courts.
FULL AND COMPLETE AGREEMENT: By using our services or purchasing our products, you consent to all of the above. These Terms and Conditions represents the entire agreement between you and Crush Publishing, Inc. and First Step Phonics. No oral agreements, understandings, or representations shall change, modify, or amend any part of this Agreement. No change or modification shall be enforceable against any party unless such change or modification is in writing and signed by the parties and supported by valid consideration. If any part of these Terms and Conditions is declared by law to be unlawful or not enforceable, the remaining provisions will stay in force. This Agreement shall be binding upon and inure to the parties hereto and their spouses, heirs, executors, administrators, successors, assigns, and representatives of any kind whatsoever.
